THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING AND PARTICIPATION ONLY IN THE UNITED STATES (EXCLUSIONS APPLY) AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED IN THIS SWEEPSTAKES IF YOU ARE NOT A RESIDENT OF THE UNITED STATES (EXCLUSIONS APPLY).
1. HOW TO ENTER: NO PURCHASE NECESSARY. Contest begins February 15, 2006 and ends February 28, 2006 (the “Promotion Period”). INTERNET ACCESS IS REQUIRED TO ENTER: Customers can enter by visiting www.sylvania.com/yeti any time from 12:00 A.M. CT on 02/15/06 through 11:59 P.M. CT on 02/28/06 and completing and submitting the online entry form. One electronic entry per e-mail address, name and mailing address. Electronic entries must be transmitted by 11:59 P.M. CT on February 28, 2006. Customers will receive one (1) entry into the sweepstakes.
Complete the information requested in the required information fields (e-mail address; full name; complete address [no P.O. Boxes]; zip code; daytime phone number, including area code; and birth date). When your registration is complete, click the area marked Submit Registration (once submitted, entry cannot be deleted, canceled, or modified). Limit one entry per person/e-mail address. You may enter the sweepstakes under one name and one e-mail address only. Enter using only an e-mail address subscribed to and registered in your name. All entries must be received during the Promotion Period. In the event of a dispute about entries submitted by multiple individuals using the same e-mail account, an entry will be deemed to have been submitted by the authorized subscriber of the e-mail account used to enter the sweepstakes at the actual time of entry. The authorized e-mail-account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet-access provider, online-service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Multiple entries per person/e-mail address or any use of robotic, repetitive, automatic, programmed, or similar entry methods or agents (including, but not limited to, sweepstakes-entry services) are prohibited and will void all entries by that entrant. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries. All entries submitted become the sole property of Sponsor and will not be returned.
Sponsor is not responsible for lost, late, non-deliverable, misdirected or any mechanical or electrical problems. Mechanically reproduced, altered, forged, mutilated or illegible sweepstakes entries will not be allowed. Sweepstakes entries not properly completed will not be allowed.
Released Parties (as hereinafter defined) are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed computer transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other errors of any kind whether human, mechanical, electronic or otherwise or for any damage to entrant's or other person's hardware or software as a result of participation.
2. PRIZE: Prize is a five-day/four-night vacation for four to the Walt Disney World® Resort near Orlando, Florida. Trip includes round-trip, coach air transportation for winner and three (3) guests from a major commercial airport near winner’s home to the Orlando International Airport; four (4) nights’ lodging (standard accommodations, quadruple occupancy); four (4) Five-Day Magic Your Way Tickets with Park Hopper ® Option and Water Park Fun and More option; use of transportation within the Walt Disney World® Resort; and round-trip transportation between the Orlando International Airport and the hotel. Approximate Retail Value (ARV): $3600. Actual value of trip may vary, depending on the point of departure and time of travel. Important Notice: All travel arrangements must be booked by January 15, 2007, and all travel must be completed by April 30, 2007. Accommodations and airfare are subject to availability. Certain restrictions and black-out dates may apply. No transfer or substitution of vacation elements will be permitted. Vacation is not redeemable for cash or subject to refunds. If winner lives within a 200-mile radius of hotel designated by Sponsor, winner will not receive the air-transportation portion of the Prize. Winner will be responsible for all tips, gratuities, service charges or taxes, meals, ground transportation not specified, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, and any other incidental costs or expenses not identified in the Complete Official Rules.
The Prize claimed will be awarded and is non-transferable. The Prize is awarded "as is" with no warranty or guarantee either expressed or implied. No substitutions or cash alternatives will be allowed except at the discretion of the Sponsor. If the Prize becomes unavailable, a prize of comparable value will be awarded.
All federal, state and local taxes and fees are based on the ARV and are the sole responsibility of the winner. The winner will be issued an IRS Tax Form 1099 stating the value of the prize for 2006 tax filing purposes.
3. ODDS: Odds of winning are dependent on the number of valid entries received.
4. ELIGIBILITY: Sweepstakes are open to legal residents of the U.S. (excluding Puerto Rico and the Virgin Islands), who are 13 years of age or older. Employees of Sponsor, its subsidiaries and affiliates are not eligible. Sweepstakes void where prohibited or restricted by law. All federal, state, and local laws and regulations apply.
If for any reason the sweepstakes are not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel or suspend the sweepstakes. Sponsor reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the sweepstakes without notice and to select the winner from all eligible entries received prior to the cancellation or termination. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or on any website, any combination thereof, or otherwise, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation in the sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
5. DRAWING: Winner will be selected in a random drawing on March 10, 2006. One (1) winner will be chosen from all valid entries. Entrants need not be present at the drawing to win.
6. AWARDING OF PRIZE: Winner will be notified by regular mail, phone or e-mail within ten (10) days of the drawing. Within ten (10) days of notification, winner must execute an Affidavit of Eligibility, Liability Release and a Publicity Release and return to Sponsor. Winner's failure to claim the prize by completing and returning the forms in a proper manner within ten (10) days of notification will result in forfeiture of the prize and drawing of an alternate winner.
Entrants agree to be bound by these Complete Official Rules. Non-compliance with these Complete Official Rules will result in disqualification. Entrants also agree to release, discharge, indemnify and hold harmless Sponsor, its employees, officers, directors, agents, representatives, parent company, subsidiaries and affiliates, and Walt Disney Parks and Resorts and its employees, officers, directors, agents, representatives, parent company, subsidiaries and affiliates, (collectively, the “Released Parties”) from any liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons (including and without limitation, death) and/or property which may be sustained in connection with the receipt, use or misuse of the Prize, or while preparing for, participating in and/or traveling to any Prize-related activity. Released Parties make no warranty with regard to, and is not responsible for, the prize awarded. Except where prohibited by law, winner's entrance and acceptance of the prize constitutes permission of the Sponsor to use winner's name, likeness, statements, biographical information, voice, voice likeness, and city and state address on a worldwide basis, and in all forms of media, in perpetuity without further compensation. Winner waives all rights to review and approve any such use.
A prize won by a minor (minor is defined by the jurisdiction of minor’s residence) will be awarded in the name of or to that minor’s parent or legal guardian or as may otherwise be deemed appropriate by Sponsor, in its sole judgment. The winner’s guests (and their parents or legal guardians if guest is a minor) will also each be required to sign and return a Release of Liability/Publicity prior to travel. If winner or any guest is a minor, winner or guest must be accompanied on the trip by his/her parent or legal guardian at winner’s sole expense, unless said parent or legal guardian travels as one of the winner’s guests.
7. WINNER: To obtain the name of the Prize winner, send a self-addressed, stamped envelope to: OSRAM SYLVANIA “Dare to Confront the Yeti” Contest Winner, 100 Endicott Street, Danvers, MA 01923.
8. PRIVACY. Upon an entrant’s submission of an entry, the entrant will have provided Sponsor with personal data. The data may be transferred to Sponsor’s offices in Danvers, Massachusetts and to contractors and subcontractors carrying out the sweepstakes. Sponsor is responsible for storing, processing and transferring the data. Entrants have the right to consult and request rectification of their information as held by Sponsor. Requests for the same should be made to OSRAM SYLVANIA, 100 Endicott Street, Danvers, MA 01923. Sponsor respects applicable data privacy regulations and will retain the entrants’ details only for the purposes stated herein. Please see OSRAM SYLVANIA’s data privacy policy at: http://www.sylvania.com/PrivacyPolicy. If you elect to receive future communications from the Walt Disney World(R) Resort and other members of the Walt Disney Family of Companies by placing a mark within the associated box on the sweepstakes entry form, your information will be shared with the Walt Disney Company and its subsidiaries, including Walt Disney Parks and Resorts LLC.
9. RELEASE OF LIABILITY. All entrants and their parents or legal guardians if entrant is a minor (both on behalf of themselves and minor entrant) agree to hold harmless and release the Released Parties and all others associated with the development and execution of this Web site and sweepstakes from any and all liability with respect to or in any way arising from this sweepstakes; participation in any sweepstakes-related activity; and/or delivery/misdelivery, acceptance, possession, use, or misuse of the Prize, including, but not limited to, liability for personal injury, bodily injury (including, without limitation, wrongful death or disability), damage to property, and damage or loss of any other kind.
10. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW YORK WITHOUT RESPECT TO CONFLICT-OF-LAW DOCTRINES. As a condition of participating in these sweepstakes, entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this sweepstakes shall be resolved individually, exclusively before a court located in New York having jurisdiction (excluding any disputes or causes of action arising out of or connected with the Prize which shall be resolved exclusively before a court located in Orange County, Florida having jurisdiction). Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages (including reasonable attorneys’ fees) other than entrants’ actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
